Unless I misinterpret what you're saying here, this is incorrect. If you are outside Tokyo and attack while there is someone in Tokyo but not in Tokyo Bay, you still do damage to the person in Tokyo as well as occupy Tokyo Bay (Tokyo City if they yield).
